Terms and Conditions

1. Cell Phone Policy: Cell phones will not allowed to be used to take photos during the session against any of the photographers, backdrops, props or any other décor that belongs to LEP. If cell phone is used to take photos, session will be stopped immediately.

2. Parking: Free parking is available at the studio for all clients. Client is responsible for any fees associate with parking and entering facilities. Such as parking tickets, meter paying, and any fees to park or entrance fees at parks and/or beaches.

3. Cancellations: In the event the Photographer must cancel, and the client cannot reschedule, all payments and initial non-refundable retainer will be refunded. If the client becomes ill and cannot attend the scheduled shoot, the client has the option to reschedule the session one time. If the session needs to be rescheduled a second time, then, there will be a fee to continue to reschedule. The initial retainer is non-refundable and non-transferable.  If the client is a no call no show on the day of the session, the client forfeits their initial retainer to the photographer.

4.  Services / Editing: Proof images are guaranteed to be delivered for selection within 3 days. At this time, client will have 30 days to select which images they will like to receive as their package images. Please note any images selected outside of the included package images will not be edited until the additional images selected are paid for through the pixie-store located in the gallery.

Client understands they are hiring the photographer for their talent and artistic style, including editing, styling, lighting, poses, etc.. Photographer will not replicate another photographer's work. Client is in agreement with the way the photographer shoots, edits and styles each session. Client agrees that they have reviewed photographers pervious work on social media or website and understands that their images will look similar.

CLIENT acknowledges and agrees that; CLIENT has reviewed PHOTOGRAPHER’s previous work and portfolio and has a reasonable expectation that PHOTOGRAPHER will perform the Services in a similar style. PHOTOGRAPHER will use its artistic judgement when providing the Services, and shall have final say regarding the aesthetic judgement and artistic quality of the Services. Disagreement with PHOTOGRAPHER’s aesthetic judgement or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

CLIENT agrees and understands that the quality of a photograph is entirely subjective. PHOTOGRAPHER will strive to present photos in a workmanlike manner but it is not required to cater to specific aesthetic preferences of CLIENT.

CLIENT agrees and understands that PHOTOGRAPHER may perform digital retouching of photos, including blemish removal, creative effects, and other digital image edits. CLIENT agrees to hold PHOTOGRAPHER harmless for any edits which may be viewed defamatory or demeaning.

Please wear the correct undergarments for whatever outfit you are wearing. If you decided to wear bright colored undergarments or colors that do not match the chosen dresses, I will not be changing the color of your undergarments to match. If you decide to wear a strapped bra instead of a strapless bra, for some of the dresses. I will not be editing the straps out. If your partner or anyone else in your images comes dressed with clothing you do not like, photographer is not responsible to fix their clothing. For example, if your partner wears sweatpants with bright yellow strips down the side, photographer will not be fixing the pants.  An extra fee of $25 per image will be associated with editing out bra straps or any other undergarments showing if you wish to have them removed.

Please note, if you decide to not follow instructions such as how to pose or body placement, photographer is not held responsible if your photos do not come out as expected. I cannot move your body in post editing into the correct position. The photographer reserves the right to decline further edit requests, that the client may feel necessary but goes against the photographer’s style, is deemed unnecessary or was the result of the client. For example, if client asks for a boho theme shoot but then later decides client wants all the decor edited out, the photographer has the right to decline such request. If client comes in with unkept hair, your photos will reflect that. I will not be editing hair to make it look straighter or kept. This also applies to clothing not kept or if later you decide you would like your clothing looking different. Please know I cannot reconstruction, faces or body parts. I will not alter anyone's body to look slimmer or broader.

I am not responsible for how your makeup looks, such as discoloration, makeup not matching the rest of your skin, heavy blush, heavy foundation, how it was blended. I will not be fixing skin tones and color discoloration as a result of how the make up was applied.

ALL SALES ARE FINAL.

5. Retainer: In consideration for the photography services provided by Photographer, client agrees to pay the sum of selected session . Client agrees to pay the photographer an initial non-refundable retainer payment of upon signing this contract. The initial non-refundable retainer payment reserves the photographer’s time and date. Non-refundable retainer so as to, fairly compensate PHOTOGRAPHER for committing her time to provide the Services and turning down other potential projects or clients. Both parties agree that the retainer will be credited towards the total Fees payable by CLIENT. Photographer agrees to not advertise availability of this same time slot to any other potential clients.

6.  Limited License to Client: Personal Use. PHOTOGRAPHER hereby grants CLIENT an exclusive, limited, irrevocable, royalty-free, non-transferable and non-sublicensable license to use Work Product for CLIENTs Personal Use, provided that CLIENT does not remove any attribution notices or copyright notices included by PHOTOGRAPHER in any Work Product. “Personal Use” includes, but is not limited to, use of photos on CLIENT’s personal social media pages or profiles;  in CLIENT’s personal creations, such as scrapbooks, albums or personal gifts; in non-commercial physical display; and in personal communications, such as family newsletter, email, or holiday card. CLIENT will not make any other use of the Work Product without PHOTOGRAPHER’s prior written consent, including but not limited to use of the Work Product for commercial sale.

7. Indemnity and Limitation of Liability: Photographer nor client and their party, is responsible for any personal loss, injury,(such as falls, slips in studio or on location) illness, or damage during time spent together. Including but not limited to consultation, photoshoot, posing, and moving from location to location. Client understands if they are taking photos in the water, they are at their own risk and photographer is not liable for any injury, illness or loss. Client understands that if they take it upon themselves to go through items in the studio such at props, fabrics, backdrops, without photographers consent and item breaks, Client is held responsible to replace such item before they will receive their pictures.

CLIENT agrees to indemnify, defend and hold harmless PHOTOGRAPHER and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to the Services and or Work Product PHOTOGRAPHER provides to CLIENT.

PHOTOGRAPHER shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of PHOTOGRAPHER (including as a result of delays in receipt of instructions from CLIENT) and for Work Product that fails to meet the specifications set out due to the actions of CLIENT or attendees, that are beyond the control of PHOTOGRAPHER (e.g., camera flashes).

CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any liability, damage, or loss related to technological failure. Camera's hard drives, and memory cards are subject to technical failure.

CLIENT understands and agrees that PHOTOGRAPHER may have cords, light stands, and other gear at the location. CLIENT will hold PHOTOGRAPHER harmless for any damage, personal injury, or loss caused by tripping over or otherwise being injured from this equipment. CLIENT further agrees to hold PHOTOGRAPHER harmless for any personal injury which may occur as the CLIENT poses or works with PHOTOGRAPHER.

8. Galleries: Client galleries are valid for 3 months and then are deleted. Client's gallery starts from time of session date and not time of final picture delivery. Package/Purchased Photos are kept for 6 months and then deleted completely from LEP's system even if client has not made final selection. Proof images are delete when package/purchased are delivered.
